In section 7, the Terms and Conditions also specify the rules for the organization of Concerts by PRO-ARTS and the participation of Participants therein.

These Terms and Conditions also constitute the terms referred to in Article 8 of the Act on Providing Services by Electronic Means.

PRO-ARTS provides the following services by electronic means (through the Website):

  • functionality enabling the online purchase of a Ticket, i.e. concluding a Ticket sales agreement for a Concert organized by the Organizer;

The basic threat is the possibility of the ICT system being infected by so-called viruses, worms, and trojan horses. To avoid related risks, it is recommended that persons using the Website install antivirus software on their device and keep it updated.

If PRO-ARTS offers services other than those described in these Terms and Conditions, other terms and conditions or model agreements may apply to those services.

Performance of an unsolicited service to a Consumer is at the risk of PRO-ARTS and does not impose any obligations on the Consumer on that account. A Consumer’s failure to respond to an unsolicited service does not constitute the Consumer’s consent to conclude any agreement.

PRO-ARTS is entitled to send commercial information to the Customer’s electronic mail (e-mail) address in accordance with the provisions of the Act on Providing Services by Electronic Means and the Electronic Communications Law Act. This may only take place after the Customer has expressly consented by clicking the relevant checkbox.

The Terms and Conditions may also be downloaded as a .pdf file and printed. Moreover, the use of any services described in section 2.3 of the Terms and Conditions requires prior acceptance thereof.

The Newsletter service is free of charge.

The Newsletter service may be available only periodically or may be entirely unavailable, depending on PRO-ARTS’s decision. The Newsletter may be sent irregularly or may periodically not be sent at all.

Purchase of Tickets via the Website
The Website enables the purchase of Tickets (conclusion of a Ticket sales agreement with PRO-ARTS) for Concerts.

If PRO-ARTS is not the Organizer, it provides online Ticket sales services for Concerts and is responsible for the proper functioning of the Website, performance of the obligation arising from the Ticket sales agreement, i.e. delivery of the Ticket in accordance with the Order, and for the conformity of the Ticket with the sales agreement, i.e. ensuring that the sold Tickets will enable participation in the Concert in accordance with the selected Ticket. PRO-ARTS may be the Organizer of Concerts, in which case it is responsible for the proper organization of those Concerts for which it is the Organizer.

A person concluding a Ticket sales agreement on behalf of a legal person or an organizational unit without legal personality to which the law grants legal capacity, as well as on behalf of any third party (such as, for example, an employer), by concluding the Ticket sales agreement, declares that they have the proper authority to represent such entity or person.

Information available via the Website concerning Tickets (in particular their date, venue, subject matter, and price) does not constitute an offer within the meaning of Article 66 of the Civil Code, but only invitations for the User to submit an offer to conclude a sales agreement for a Ticket on their behalf, as specified in Article 71 of the Civil Code.

After ознакомizing themselves with these Terms and Conditions, in particular with the information referred to in sections 4 and 5 of the Terms and Conditions, in order to purchase a Ticket the User selects from the list of Concerts available on the Website the Concert for which they wish to purchase a Ticket, selects the “add to cart”, “dodaj do koszyka”, or similar option, then completes the relevant forms (in particular the form described in section 4.6) available on the Website and accepts these Terms and Conditions by ticking the relevant checkbox and potentially other mandatory checkboxes, and the procedure is completed by the User clicking the button labeled “Place Order”, which is equivalent to confirmation by the User that the form has been completed correctly, and that the User is aware that performance of the agreement entails the obligation to pay the price for the Ticket in the amount specified in detail in the description of the selected Concert. An Order submitted in this way constitutes an offer to conclude a Ticket sales agreement within the meaning of the Civil Code, submitted by the User.

A User wishing to conclude a Ticket sales agreement with PRO-ARTS, after selecting the Concert for which they wish to purchase a Ticket, completes a form by providing, selecting, or accepting the following data and information:

Mandatory information:

  • the number of Tickets the User wishes to purchase;
    (subject to any limits described in section 4.7.)
    and then, after selecting the “proceed to checkout” button:
  • the User’s full name;
  • the User’s e-mail address;
  • the User’s contact telephone number;

Optional information or information available only for selected Concerts:

  • the names and surnames of the persons for whose benefit the Tickets are purchased*;
    (if a Personalized Ticket is being purchased in accordance with section 4.7.1.)
  • the User’s correspondence (postal) address*;
    (only in the case of purchasing a paper Ticket in accordance with section 4.7.2.)
  • the Ticket form and type in accordance with section 4.7., seat location in the audience, or other specific information regarding the Ticket;*
    (only if such a choice is possible for a given Concert)
  • acknowledgement and acceptance of the Concert regulations, Organizer regulations, venue rules, and Ticket sales regulations for a given Concert (if such regulations apply to the selected Concert), as well as other regulations or separate rules applicable to a given Concert;
    (if such documents have been prepared and their acceptance is required for a given Concert)
  • the Ticket delivery method
    (only in the case of purchasing a paper Ticket).
  • VAT invoice details, if different from the details provided earlier, if a VAT invoice is to be issued to the User;
  • any additional information concerning the order.

Depending on the nature of the Concert and the ticket offer prepared by a given Organizer, the following types of Tickets may be available exclusively or optionally:

  • Personalized Ticket or bearer Ticket;
  • paper Ticket or Electronic Ticket;
  • regular Ticket or Discount Ticket.

The Ticket form depends on the requirements and conditions specified by the Organizer. If there is a possibility to choose between different forms, the User makes that choice by selecting the appropriate forms in the form referred to in section 4.6. The number of Tickets that may be purchased for a given Concert under one Order may be limited.

By default, the available form of Ticket for purchase is a regular, electronic, bearer Ticket. In the absence of separate information provided during Ticket purchase on the Website, the User purchases the Ticket form described above.

Concerts may have separate regulations or other binding documents created by the Organizer, referred to in section 4.6.8 of these Terms and Conditions. PRO-ARTS has no influence over their content, and acceptance of such documents may be necessary to conclude a Ticket sales agreement.

The Electronic Ticket is sent to the e-mail address indicated by the User in the form referred to in section 4.6 of these Terms and Conditions in a form enabling digital storage (download) of the Electronic Ticket on the User’s mobile devices, computers, or similar devices. The User declares that the provided e-mail address is one to which they have access and that they are aware that providing an incorrect e-mail address will result in the purchased Electronic Ticket (or Electronic Tickets) being sent to that address.

In the case of purchasing Personalized Tickets, the User – depending on the requirements of the Organizer or PRO-ARTS – may be obliged to provide the personal data of the persons who are to be authorized, on the basis of the Tickets, to attend the Concert, in accordance with the Organizer’s requirements. Depending on the Organizer’s decision and the provisions of the Organizer’s regulations, it may be necessary to provide the data of all holders of personalized tickets, or only of the User making the Ticket purchase transaction. The possible admissibility of later changes to the data on the Ticket or Tickets is determined by the Organizer’s regulations or the regulations of the given Concert. In the absence of separate regulations, any change of data requires contact with PRO-ARTS each time.

If, after completion of the form referred to in section 4.6 of these Terms and Conditions, performance of the agreement is possible, an electronic message confirming the conclusion of the Ticket sales agreement (Ticket(s)) will be sent to the User’s e-mail address. This confirmation constitutes PRO-ARTS’s statement of acceptance of the offer. At that moment, the Ticket sales agreement between the Customer and PRO-ARTS is concluded.

The User shall pay for the Ticket or Tickets in accordance with section 5 of these Terms and Conditions.

Settlement of the transactions referred to in section 4.13 above is carried out via services belonging to third parties other than PRO-ARTS. In order to make payment in this form, it may be necessary to accept the regulations of the entities described in the first sentence.

A User who is not a Consumer consents to the issuance of an electronic VAT invoice without the need to provide their signature and to its delivery to the e-mail address provided in accordance with section 4.6.3.

The date and venue of the Concert, as well as the participation conditions, are presented by the Organizer.

PRO-ARTS or the Organizer may, in the period between the conclusion of the Ticket sales agreement and the date of the Concert, send the User additional information about the Concert.

A Consumer concluding a Ticket sales agreement with PRO-ARTS via the Website may withdraw from it within 14 (fourteen) days from the date of its conclusion. The right of withdrawal referred to in the previous sentence may be exercised by submitting an appropriate statement in writing or by e-mail to the addresses indicated in section 2.4 of these Terms and Conditions, whereby it is sufficient for compliance with the deadline indicated in the previous sentence that the statement be sent to PRO-ARTS before its expiry at the following address: os. Piastów 31/17, 31-624 Kraków. The statement of withdrawal may be made using the form attached to these Terms and Conditions.

If the right of withdrawal is exercised, PRO-ARTS shall refund the Consumer all payments made without delay, but no later than within 14 (fourteen) days from receipt of the Consumer’s statement of withdrawal from the agreement, using the same payment method as used by the Consumer, unless the Consumer has agreed to a different refund method that does not involve any costs for them.

The right of withdrawal described above does not apply to a Consumer in relation to an agreement under which the Organizer has fully performed the service with the Consumer’s express consent, where the Consumer was informed before the commencement of the service that after the Organizer’s performance they would lose the right to withdraw from the agreement (pursuant to Article 38(1) of the Consumer Rights Act).

The right of withdrawal described above also does not apply in cases where it is excluded under the law, in particular pursuant to Article 38(12) of the Consumer Rights Act, i.e. in particular with regard to agreements for the provision of services related to entertainment events if the agreement specifies the date of the service.

A User who has purchased a Ticket has the right to a refund of the Ticket, regardless of the above consumer right of withdrawal, in the event of a change in the date or location of the Concert and in other circumstances arising from the law.

A User who has purchased a Ticket may also be entitled to withdraw from the Ticket sales agreement or obtain a refund of the Ticket if such a provision results from the Organizer’s regulations, the Concert regulations, or if FPHU has otherwise granted such right to the User.

In the event of effective withdrawal from the Ticket sales agreement or refund of the Ticket by the User, PRO-ARTS shall refund the funds for the Ticket purchase immediately after receiving the funds from the Organizer. The refund shall by default be made in the same manner as the payment was made, unless the User requests another method. For this purpose, the User must contact PRO-ARTS via the addresses described in section 2.4 of these Terms and Conditions.

If the User who purchased a Personalized Ticket wishes to change the data on the Ticket, they should contact PRO-ARTS using the PRO-ARTS contact details provided in section 2.4 of these Terms and Conditions. PRO-ARTS does not guarantee the possibility of changing the data, and the introduction of such a change requires individual arrangements each time. PRO-ARTS is not obliged to accept any request to change the data on a purchased Ticket, including in particular requests to change essential elements of the Ticket submitted after the purchase of the Ticket, especially such as: changes to the venue and date of the Concert, seats within the Concert (audience seats), the date or start time, as well as data on the Personalized Ticket.

The conditions for purchase, refund, or change of data on Tickets may be modified in the Organizers’ regulations or Concert regulations and other similar documents applicable to the given Concerts.

When purchasing a Ticket via the Website, the User may use an additional functionality consisting in generating (via Google Maps) a route to the Concert venue from any entered location. PRO-ARTS does not collect or process location data entered when using the described functionality. The route to the Concert venue and travel time provided in this way are indicative only, and PRO-ARTS is not responsible for their accuracy.

Prices and Payment for Tickets
The Ticket price is stated each time on the Website in the description of the given Concert.

The Ticket price may vary depending on the Ticket type and form, the selected seat in the audience, and other variables characteristic of the given Concert. The price of each type and form of Ticket is stated for each form and type of Ticket.

Ticket prices are given in Polish zloty (PLN) and are gross prices (including VAT at the applicable rate). The Ticket price may vary depending on the selected Ticket category, selected seat in the audience, or other variables proposed by the Organizer or PRO-ARTS.

Unless other payment terms are specified when concluding the agreement, the Customer shall pay the amount indicated in the description of the selected Ticket variant using one of the selected online payment methods:

  • bank transfer;
  • via the Przelewy24 service;
  • PayPal;
  • Blik;
  • Apple Pay or Google Pay.

Payments in the above forms are made via third parties in accordance with their regulations, acceptance of which may be necessary in order to purchase a Ticket.

The User bears the costs associated with the selected payment method and the costs of Ticket delivery.

If payment is not received within 3 days after placing the Order together with payment of the fee, PRO-ARTS may withdraw from the agreement after first requesting payment within a period which shall in principle not be shorter than 4 days. Withdrawal takes effect by informing the User at the e-mail address indicated in the form referred to in section 4.6 that the Order has been cancelled.

Complaint Procedure
Customers may report any irregularities or complaints related to any of the services provided by PRO-ARTS to the address [_31-624 Kraków, os. Piastów 31/17]. Complaints may also be submitted via the public postal operator, within the meaning of the Postal Law Act of 23 November 2012 (Journal of Laws of 2017, item 1481), to the correspondence address given in section 2.4.3.

A complaint should contain:

  • identification of the complainant, with the indication of necessary identifying data, including the e-mail address (a password should not be sent);
  • identification of the agreement, service, or transaction to which the complaint relates and an indication of what the irregularity consists in.

If the required information is missing, PRO-ARTS shall request the complainant to supplement it.

During the complaint process, PRO-ARTS may request additional explanations, documents, or verification of the course of the event subject to the complaint.

Complaints shall be examined within 14 business days from receipt by PRO-ARTS of a complaint containing all necessary data. PRO-ARTS shall immediately inform the complainant of the outcome of the complaint by e-mail.

PRO-ARTS shall make efforts to ensure that complaints are considered without undue delay.

After exhausting the procedure regulated in this section, a User who is a Consumer may pursue their claims through the courts or use out-of-court complaint mechanisms permitted by law, in particular mediation and a permanent arbitration court run by the competent units of the Trade Inspection, as well as obtain assistance in this respect from the competent district or municipal consumer ombudsman (provided that PRO-ARTS is not obliged to consent to the use of out-of-court complaint resolution methods). Detailed information about the possibility of using out-of-court procedures may be available, among others, at the offices of the competent authorities (municipal and district consumer ombudsmen, Voivodeship Inspectorates of Trade Inspection) and on their websites, as well as on the website of the Office of Competition and Consumer Protection (www.uokik.gov.pl).

Organization of Concerts by PRO-ARTS
PRO-ARTS may be the Organizer of Concerts for which Tickets are available for sale on the Website. In such a case, purchasing a Ticket is also connected with concluding an agreement for participation in the Concert (provision of entertainment services in the form of organizing and enabling participation in the Concert). In such a case, the provisions of section 7 of these Terms and Conditions apply to Concerts organized by PRO-ARTS. Regardless of the provisions of section 7 of these Terms and Conditions, participation in a given Concert may require acceptance of a separate set of regulations applicable to that Concert. If the Organizer is an entity other than PRO-ARTS, PRO-ARTS is not responsible for the course, organization of the Concert, or the content of the regulations for such Concert, and is obliged only to the extent described in section 4.2 of these Terms and Conditions.

Where PRO-ARTS is the Organizer of a Concert, PRO-ARTS is responsible not only for the sale of the Ticket, but also for the proper performance of the service consisting in organizing and enabling the Participant to attend the Concert. In this respect, the provisions of these Terms and Conditions shall apply accordingly, in particular sections 4.18–4.26 and section 6 in its entirety.

The Concert takes place at the time and place specified on the Ticket. PRO-ARTS recommends arriving at the Concert venue at least 30 minutes earlier to allow for efficient entry to the venue where the Concert takes place. Arrival at the Concert venue after the starting time indicated on the Ticket may result in the concert participant not being admitted to the Concert due to its prior commencement (depending on the nature of the concert and whether the participant’s entry could disturb it).

Participants are obliged to hold a valid Ticket and, in certain cases (in particular when using Personalized Tickets or Discount Tickets), also an identity document or a document confirming the right to use a Discount Ticket. Entry to the Concert without a valid Ticket and, in certain justified circumstances, without the other required documents is impossible. The Ticket held entitles one Participant to a single admission to the Concert.

Leaving the Concert venue (beyond the point where the Ticket was checked) results in the loss of the right to return to the Concert.

Participants and all other persons present at the Concert venue are obliged to behave in a manner that does not endanger the safety of others and, in particular, to comply with the provisions of these Terms and Conditions. It is prohibited to destroy infrastructure, including greenery, litter the area, destroy markings and information boards, advertising media, devices and equipment located at the Concert venue, and similar items. Participants are obliged to use sanitary facilities exclusively in accordance with their intended purpose.

PRO-ARTS or persons constituting the staff of the venue where the Concert takes place are entitled to refuse participation in the Concert or presence at the Concert venue to a Participant who:

  • does not have a Ticket or another document described in section 7.4 of the Terms and Conditions;
  • is under the influence of alcohol or other intoxicating substances;
  • poses a threat to other Participants, concert organizers, artists, or other persons present at the Concert;
  • through their behavior hinders or prevents the undisturbed conduct of the Concert;
  • possesses weapons, explosives, or other objects that may pose a threat to safety;
  • fails to comply with the provisions of these Terms and Conditions, in particular section 7.

PRO-ARTS is entitled to record the Concert in any form (including audio and video), and Participants may be included in the recording as part of the whole recording.

PRO-ARTS is entitled to change the course of the Concert or cancel it for justified reasons that could not have been foreseen, including due to force majeure. In such a situation, the Ticket holder is entitled either to attend the Concert on the new date or to a refund of the Ticket, of which they shall be informed by PRO-ARTS.

If the Concert does not take place for reasons attributable to PRO-ARTS, the Participant is entitled to a refund of the funds paid for the purchase of the Ticket or to the possibility of attending the Concert on a newly scheduled date. In order to obtain a Ticket for the new date or a refund, the Participant should contact PRO-ARTS via the contact addresses given in section 2.4.

Section 6 of these Terms and Conditions applies to complaints concerning Concerts organized by PRO-ARTS.

In matters concerning the organization of Concerts by PRO-ARTS, the Participant may contact PRO-ARTS at the contact addresses indicated in section 2.4.

Legal Notice
The Website was prepared on behalf of PRO-ARTS.

The content and structure of the Website are protected by copyright. Reproduction of data or information, in particular the use of materials and texts posted on the Website (including these Terms and Conditions), as well as their fragments and photographs or films, for purposes other than those expressly permitted by law, without the consent of PRO-ARTS, is prohibited.

Amendment of the Terms and Conditions
PRO-ARTS is entitled to amend these Terms and Conditions, in particular for reasons such as changes in the law, including in particular statutory changes, changes in the Website’s functionalities, and/or changes in the scope of services provided.

An amendment to these Terms and Conditions shall enter into force on the date indicated by PRO-ARTS, which shall each time be no shorter than 7 days from the date the new Terms and Conditions are made available to the e-mail address provided by the User.

PRO-ARTS shall inform Users of changes to these Terms and Conditions by sending a new version of the Terms and Conditions together with information on the amended provisions or by making the new version of the Terms and Conditions available to the User’s e-mail address.

Changes to these Terms and Conditions shall be binding on the User unless the User objects to PRO-ARTS (by sending the objection to the contact addresses provided in section 2.4 of these Terms and Conditions) within 7 days from the date of being notified of the amendment. An amendment to these Terms and Conditions shall not apply to Tickets purchased before the amendment enters into force.

An objection must be submitted, under pain of nullity, in writing or in documentary form by e-mail.

Final Provisions
Any disputes arising between PRO-ARTS and a Customer who is not a Consumer shall be submitted to the court having jurisdiction over the address indicated in section 2.4.3 of these Terms and Conditions.

Polish law shall apply to the assessment of the rights and obligations of the parties arising from these Terms and Conditions where the Customer is not a Consumer. If the Customer is a Consumer, jurisdiction and applicable law shall be determined in accordance with the relevant provisions.

PRO-ARTS is not bound by any additional, non-mandatory codes of good practice or other similar documents, which does not limit the fact that under generally binding legal provisions PRO-ARTS is already obliged not to infringe the principles of fair competition and not to apply unfair market practices.

The section numbers (sections) cited in these Terms and Conditions without further indication mean the relevant editorial units of these Terms and Conditions.

These Terms and Conditions enter into force on [_1.12.] 2025.
